Rights Attestation

Version: 0.2.0 (draft) · Effective: upon publication

This Rights Attestation is presented to you each time you submit a release for moderation on Sazalem. By selecting "I attest" you make a sworn declaration with the legal force of an electronic signature under the laws of the Republic of Kazakhstan and you accept the legal consequences of any false statement set out in §10 below. If you cannot make any of the following statements truthfully and without qualification, do not submit the release — contact legal@sazalem.com for guidance instead.

The release identifier, the time of submission, your IP address, your user-agent and your account identifier are recorded together with this attestation in our immutable audit log.

1. Identity and authority

1.1. I am the natural person, or an authorized representative of the legal person or estate, identified in my Sazalem account, and the identity-verification (KYC) information I have submitted is accurate.

1.2. I have the legal capacity and full authority to submit this release and to make every representation and warranty set out below. If I am acting on behalf of another person, entity, group, label, distributor, publisher, estate or rights-holder, I have written authorization from each such party covering each act required to publish this release on the Service.

2. Rights ownership

2.1. I either (a) am the original author and exclusive owner of every right necessary to publish this release on the Service, or (b) hold valid, current and unrevoked written licenses or assignments from each applicable rights-holder that grant me the rights I am purporting to grant Sazalem under the Content License.

2.2. The rights I represent that I hold include, without limitation:

  • the master recording right in the sound recording (sometimes

called the producer's neighboring right);

  • the musical-work right in the underlying composition (music);
  • the literary-work right in the lyrics, spoken text, narration or

poem;

  • the right to any sample, interpolation, recitation or quotation

embedded in the recording;

  • the arranger's right in any new arrangement;
  • the performer's neighboring right of every performer audible on

the recording;

  • the artwork right in any cover image, photograph or illustration

associated with the release;

  • the translation right in any translation supplied;
  • the personality, image and voice right of every identifiable

person heard or depicted, including the consent of any individual whose voice has been cloned, modelled or imitated.

2.3. To the best of my knowledge after diligent enquiry there is no pending claim, dispute, lien, encumbrance or rival ownership assertion in respect of any element of this release.

3. Splits, credits and metadata

3.1. The royalty splits I have entered for this release are accurate and complete. They have been agreed in writing by every co-contributor listed (composer, lyricist, performer, arranger, producer and any other credited party). The percentages add to one hundred per cent (100 %) within each split kind.

3.2. The metadata I have entered (title, performer, composer, lyricist, year of creation, year of release, language, genre, content-type classification, ISRC and ISWC where applicable) is correct.

3.3. Where this release is a cover, adaptation, sample-based work or contains a public-domain element, I have declared that fact in the upload form and I have either (a) obtained a mechanical, sample or adaptation license from the relevant rights-holder, or (b) confirmed in good faith that the source element is in the public domain in the Republic of Kazakhstan and in every other territory in which the release will be available on the Service.

4. AI disclosure

4.1. I have truthfully indicated whether and to what extent this release was created with the assistance of generative artificial intelligence, choosing one of: Not AI-generated / Partially AI-generated / Fully AI-generated.

4.2. I have not used any third party's voice, likeness, distinctive performance style or trade-marked signature without that party's express written consent.

4.3. The AI tools or models I used did not, to the best of my knowledge after enquiry, produce output that infringes any third-party right.

5. Acceptable Use compliance

This release complies in full with the Acceptable Use Policy. In particular, the release does not contain prohibited content as defined in that policy (including but not limited to material that is sexually exploitative of minors, that incites violence or hatred, that constitutes targeted harassment or doxing, that is fraudulent or deceptive, or that is unlawful under Kazakhstan law).

6. Sanctions and export controls

I am not, and no contributor named in the release is, a person or entity (a) listed on any sanctions list maintained by the United Nations Security Council, the European Union, the United Kingdom, the United States, the Republic of Kazakhstan or another competent authority, or (b) located in or ordinarily resident in a jurisdiction subject to comprehensive sanctions.

7. Tax and beneficial-ownership disclosure

7.1. The natural-person or legal-entity beneficial owner who will ultimately receive royalty payments for this release is correctly identified in my Sazalem account or in the splits panel.

7.2. I am responsible, alone or jointly with my co-contributors, for all taxes that fall on me with respect to royalty payments, save those that Abyroy or Sazalem are legally required to withhold and remit on my behalf.

8. Authority to grant licenses

I have authority to grant, and I do grant, the licenses described in the Content License and to consent to the royalty-administration arrangements described in the Royalty & Payout Agreement.

9. Continuing obligation

If I become aware after submission of any fact that would render any statement in this attestation untrue, I will notify Sazalem at legal@sazalem.com without undue delay and, where appropriate, withdraw the release.

10. Consequences of a false attestation

10.1. Civil consequences. A false attestation is a material breach of the Content License and the Terms of Service, entitles Sazalem and any harmed rights-holder to seek injunctive relief and damages (including the indemnity in §5 of the Content License), and may result in suspension or termination of my account, removal of all my content, withholding or claw-back of royalties already paid, and blacklisting from future re-registration.

10.2. Criminal consequences. Knowingly false statements may constitute a criminal offence under Kazakhstan law, including but not limited to articles of the Criminal Code of the Republic of Kazakhstan concerning fraud, copyright infringement, forgery and the giving of knowingly false information to a recognized electronic identification system.

10.3. Reporting. Sazalem may, and where required by law will, report suspected false attestations to law-enforcement authorities, to Abyroy, to affected rights-holders and to other platforms.

11. Electronic signature

By selecting "I attest" I confirm that I have read this Rights Attestation in full, that every statement I have made in or in connection with this release submission is true, accurate and complete in all material respects, and that this electronic acknowledgment has the legal force of a handwritten signature for the purposes of the laws of the Republic of Kazakhstan and any other applicable jurisdiction.
